Welcome to Yumekai ("the Platform"). By accessing or using Yumekai, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the Platform.

1. Eligibility

You must be at least 13 years old to use Yumekai. If you are under 18, you must have parental or guardian consent. Age-restricted content (if any) requires age verification and is only available to users 18 years or older.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information during registration and to keep your account information up to date. You are responsible for all activity that occurs under your account.

3. AI-Generated Content

Yumekai uses artificial intelligence to generate character dialogue, images, and other content. AI-generated content may not always be accurate, appropriate, or aligned with your expectations. We do not guarantee the quality, accuracy, or suitability of AI-generated content. You acknowledge that AI characters are fictional and their responses do not constitute professional advice of any kind.

You are solely responsible for how you use, share, or distribute AI-generated content (including images, portraits, and conversation text) outside the Platform. Yumekai is not liable for any consequences arising from your distribution, publication, or commercial use of AI-generated content.

AI-generated images may unintentionally resemble existing copyrighted characters, real people, or trademarks. You assume all legal risk associated with using, sharing, or distributing such content. Yumekai does not verify the legality of AI-generated content for any specific jurisdiction or use case.

While we employ AI safety filters and content moderation to prevent the generation of harmful, violent, sexually explicit, or otherwise objectionable content, no filtering system is perfect. If AI-generated content bypasses our safety measures, Yumekai is not liable for any resulting harm, offense, or damages. You agree to report any inappropriate content immediately to hello@yumekai.gg.

You agree not to intentionally manipulate, circumvent, or "jailbreak" the AI system to produce prohibited content, including sexually explicit material, violent imagery, hate speech, or content depicting minors in any inappropriate context. Violations will result in immediate account termination and may be reported to law enforcement.

4. User-Created Content

You may create custom AI characters, including names, descriptions, personality traits, and backstories. You retain ownership of the creative elements you provide. By submitting content to the Platform, you grant Yumekai a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the Platform for the purpose of providing the service. You must not create characters that infringe on third-party intellectual property rights.

5. Prohibited Uses

You agree not to:

  • Use the Platform for any unlawful purpose
  • Create content that promotes violence, hatred, or discrimination
  • Attempt to generate content depicting minors in sexual or harmful situations
  • Harass, abuse, or harm other users
  • Attempt to reverse-engineer, exploit, or compromise the Platform's systems
  • Use automated tools (bots, scrapers) to access the Platform without permission
  • Circumvent usage limits, content filters, or safety mechanisms
  • Resell or commercially redistribute content generated by the Platform

6. Content Moderation

We reserve the right to moderate, filter, or remove content that violates these Terms or our community guidelines. Content moderation may be performed by automated systems and/or human reviewers. If you believe content has been incorrectly moderated, you may contact us at hello@yumekai.gg.

7. Subscriptions & Payments

Yumekai offers both free and paid subscription tiers. Paid subscriptions are billed on a recurring basis (monthly or annually) and automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. Prices may change with reasonable notice. All payments are processed through secure third-party payment processors.

7.5 Dream Coins & Virtual Currency

  • Dream Coins are a virtual currency used within the Platform for character creation and additional messages.
  • Dream Coins have no cash value and are non-refundable. Unused coins are forfeited upon account deletion.
  • Dream Coins cannot be transferred, sold, or exchanged outside the Platform.
  • We reserve the right to modify coin pricing and packages with reasonable notice.

7.6 Refund Policy

Refunds for Pro subscriptions may be requested within 7 days of initial purchase by contacting hello@yumekai.gg. After 7 days, no refunds are provided.

8. Data & Conversations

Your conversations with AI characters are stored to provide memory and continuity features. You may delete your conversation history at any time. For details on how we collect, use, and protect your data, please see our Privacy Policy.

9. Intellectual Property

The Platform, including its design, code, pre-built characters, illustrations, and branding, is owned by Yumekai Studio. AI-generated character portraits are created using third-party AI models and are provided for personal use within the Platform. You may not claim exclusive ownership of AI-generated images.

10. Limitation of Liability

Yumekai is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, Yumekai Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Yumekai Studio, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform or violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will remain in effect.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to binding arbitration in accordance with applicable rules, unless prohibited by local law.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Yumekai Studio is established, without regard to conflict of law principles.
